1. About These Terms
These Terms of Use govern your access to and use of Maoni Africa, including our website, accounts, polls, results, dashboards, Maoni Tally and related services.
By accessing or using Maoni Africa, you agree to comply with these Terms. If you do not agree with them, you should not use the platform.
2. About Maoni Africa
Maoni Africa is a digital platform providing tools and services relating to public opinion, polling, research, election-related information and results tallying.
Some information appearing on the platform may be created or submitted by users or third parties and should not automatically be understood as an official statement, certified election result or independently verified research finding.
3. User Accounts
Some Maoni Africa services require you to create an account.
You are responsible for providing accurate account information where required and for keeping your login credentials secure.
You must not knowingly allow another person to use your account in a way that breaches these Terms.
You should notify Maoni Africa if you reasonably believe that your account has been compromised.
4. Creating Polls
Users may be able to create and publish polls through Maoni Africa. The person creating a poll is responsible for the poll question, answer choices and other content they submit.
Poll creators must not use Maoni Africa to publish content that is unlawful, fraudulent, deliberately deceptive, threatening, defamatory, discriminatory, abusive or otherwise prohibited by applicable law.
Poll creators must not impersonate an individual, organisation, government body, election authority or other entity in a misleading manner.
5. Participating in Polls
Where a poll is intended to allow one response per person, email, device or other defined identifier, you must not deliberately attempt to submit multiple responses in order to manipulate the result.
You must not use automated systems, bots, scripts, fabricated identities, coordinated technical attacks or other methods intended to artificially alter poll results.
Maoni Africa may use verification, rate-limiting and anti-abuse controls to protect the integrity of polls.
6. Understanding Online Poll Results
Unless expressly stated otherwise, a poll published on Maoni Africa should not automatically be treated as a scientific opinion poll or as representative of an entire population.
Results may reflect only people who became aware of a poll and chose to participate. Online participation, sample size, audience selection, question wording and other factors can affect results.
Where Maoni Africa conducts or publishes formal research using a defined methodology, additional information about the methodology, sample or scope may be provided with that research.
7. Maoni Tally
Maoni Tally provides tools for collecting, organising, reviewing and displaying election-related results or tally information.
Unless Maoni Africa expressly states otherwise, information displayed through Maoni Tally is not an official declaration of an election result.
Official election results are determined and declared by the authority legally responsible for the relevant election.
Users submitting tally information must make reasonable efforts to ensure that information is accurate and must not knowingly submit fabricated, altered or misleading results.
8. Election and Political Content
Maoni Africa may contain public opinion, electoral and political information.
The existence of a poll, candidate, political party, result, opinion or other political content on the platform does not by itself constitute an endorsement by Maoni Africa.
Users must comply with applicable election, communications, data protection and other laws when using Maoni Africa for election-related activities.
9. Prohibited Conduct
You must not use Maoni Africa to:
- break applicable law or encourage unlawful activity;
- manipulate polls or tally results;
- interfere with the security or operation of the platform;
- attempt to bypass authentication, verification, rate limits or other security controls;
- gain unauthorised access to another person's account or restricted information;
- distribute malware or malicious code;
- conduct automated scraping or extraction in a manner that damages or materially disrupts the service;
- impersonate another person or organisation deceptively;
- submit information that you know is false for the purpose of corrupting a poll or tally; or
- use the platform in a manner that threatens the rights, privacy or safety of others.
10. User Content
You remain responsible for content that you submit to Maoni Africa.
By submitting content intended for publication through the platform, you give Maoni Africa permission to host, process, reproduce and display that content to the extent reasonably necessary to operate the service.
You must have the necessary rights or authority to submit content that you provide.
11. Moderation and Enforcement
Maoni Africa may investigate suspected misuse and may restrict, suspend, remove or disable accounts, polls, content or access where reasonably necessary to protect the platform, other users, the public or to comply with applicable law.
We may also preserve relevant information where reasonably necessary for security investigations, dispute resolution or legal compliance, subject to applicable data protection requirements.
12. Intellectual Property
The Maoni Africa name, branding, platform design, software and original platform content may be protected by intellectual property laws.
Except where permitted by law or expressly authorised, you may not copy, reproduce, modify, distribute or commercially exploit protected Maoni Africa material without permission.
13. Third-Party Services
Maoni Africa relies on third-party technology providers and internet infrastructure to provide parts of the service.
We are not responsible for independent third-party websites or services that you choose to access outside Maoni Africa.
14. Availability of the Service
We aim to provide a reliable service, but we do not guarantee that Maoni Africa will always be available, uninterrupted or error-free.
Maintenance, technical failures, internet outages, security incidents or circumstances outside our reasonable control may occasionally affect availability.
15. Accuracy of Information
We take reasonable steps to maintain the platform, but user-generated information, public polls and third-party information may contain errors or inaccuracies.
Users should exercise appropriate judgement before relying on information from Maoni Africa for significant legal, financial, electoral, commercial or other decisions.
16. Limitation of Liability
To the extent permitted by applicable law, Maoni Africa will not be liable for indirect, incidental or consequential loss arising solely from use of, inability to use, or reliance on the platform.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.

18. Suspension and Termination
You may stop using Maoni Africa at any time.
We may suspend or restrict access where reasonably necessary because of suspected abuse, security concerns, serious or repeated breaches of these Terms, or legal requirements.

We may update these Terms as Maoni Africa develops or where legal, security or operational requirements change.
The latest version will be published on this page together with its updated effective date.
20. Governing Law
These Terms are primarily governed by the laws of Kenya, subject to any mandatory rights or protections that may apply to a user under the laws of another jurisdiction.
