1. About Maoni Africa
Maoni Africa is a digital platform for public opinion, polling, research and election-related tallying and intelligence.
This Privacy Policy explains how Maoni Africa collects, uses, stores, shares and protects personal data when you use our website, create an account, create or participate in polls, use Maoni Tally, contact us, or otherwise interact with our services.
Our primary data protection framework is the Data Protection Act, 2019 of Kenya and applicable regulations made under it. Where our services are used from another country, additional privacy rights available under applicable local law may also apply.
2. Information We Collect
Depending on how you use Maoni Africa, we may process the following categories of information:
- Account information: such as your email address, authentication information and account identifiers.
- Poll and tally information: information you provide when creating, administering or participating in polls and tallying activities.
- Voting verification information: information necessary to verify a voting request and reduce duplicate or fraudulent voting.
- Technical information: such as IP address, device or browser information, security identifiers, timestamps and technical logs.
- Communications: information you provide when you contact or communicate with Maoni Africa.
3. Poll Voting and Verification
Maoni Africa uses technical and verification measures designed to protect the integrity of online polls. Depending on the poll and security controls in use, these measures may include email verification, device identifiers, IP-related information, verification tokens and other anti-abuse signals.
Where possible and appropriate, identifiers used for duplicate-vote prevention may be transformed or hashed rather than retained in directly readable form.
These controls are used for purposes such as confirming voting eligibility within the rules of a poll, preventing repeated submissions, detecting abuse, maintaining system security and protecting the reliability of poll results.
4. How We Use Personal Data
We may use personal data to:
- create, secure and administer user accounts;
- provide polling, research and tallying functionality;
- verify voting requests and prevent duplicate, automated or fraudulent activity;
- authenticate users and recover accounts;
- send transactional communications such as account verification, security codes and password recovery messages;
- operate, maintain and improve the platform;
- investigate security incidents, misuse or suspected fraud;
- enforce our Terms of Use;
- comply with applicable legal and regulatory obligations; and
- protect Maoni Africa, its users and the public from misuse of the platform.
5. Our Basis for Processing
We process personal data only where there is an appropriate lawful basis for doing so under applicable data protection law.
Depending on the circumstances, this may include your consent, performance of a service requested by you, compliance with a legal obligation, or legitimate interests such as securing the platform, preventing fraud and maintaining the integrity of polls.
Where consent is the appropriate legal basis, you may withdraw that consent subject to applicable law. Withdrawal does not make processing that was lawful before withdrawal unlawful.
6. Poll Results and Public Information
Some polls and tallying pages on Maoni Africa are intended to be public. Poll questions, choices, aggregate results, election information and other information designated as public may therefore be visible to other users and visitors.
Maoni Africa does not intend to publicly display a voter's private account credentials or verification information as part of ordinary aggregate poll results.
7. Service Providers
We use trusted technology and service providers to operate Maoni Africa. These may include providers of hosting, database infrastructure, authentication, security, email delivery, abuse prevention, traffic management and related technical services.
These providers may process limited personal data where necessary to provide their services to us. We seek to use providers that offer appropriate privacy and security protections.
We do not sell personal data merely because you create an account or vote in a poll.
8. International Data Transfers
Maoni Africa uses internet infrastructure and service providers that may process or store information outside Kenya.
Where personal data is transferred internationally, we seek to use appropriate safeguards required by applicable law, including the requirements of Kenya's data protection framework relating to transfers of personal data outside Kenya.
9. Data Retention
We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, including providing the service, maintaining poll integrity, resolving disputes, protecting the platform and satisfying legal or regulatory requirements.
Different categories of information may therefore have different retention periods. Information that is no longer reasonably required may be deleted, anonymised or otherwise handled in accordance with applicable law.
10. Data Security
We use technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.
These measures may include encrypted communications, access controls, authentication safeguards, verification systems, anti-automation protections, rate limiting and security monitoring.
No internet-based service can guarantee absolute security. Users should also protect their passwords and account credentials and notify us if they suspect unauthorised access.
11. Your Data Protection Rights
Subject to applicable law and any lawful exceptions, you may have the right to:
- be informed about how your personal data is used;
- request access to personal data held about you;
- request correction of inaccurate or misleading information;
- request deletion of personal data where applicable;
- object to certain processing;
- request restriction of certain processing where provided by law;
- request data portability where applicable; and
- withdraw consent where processing depends on consent.
We may need to verify your identity before acting on a privacy request in order to protect your information against unauthorised access.
12. International Users
Maoni Africa may be accessed from countries outside Kenya. If privacy legislation applicable to you provides additional mandatory rights, we will handle valid requests in accordance with those applicable requirements.
Nothing in this Privacy Policy is intended to remove rights that cannot lawfully be waived under applicable data protection legislation.
13. Children's Privacy
Maoni Africa is not designed for children to create accounts or provide personal information without any consent or authorisation required by applicable law.
If we become aware that personal data relating to a child has been collected contrary to applicable requirements, we may take appropriate steps to restrict or delete that information.
14. Cookies and Similar Technologies
Maoni Africa may use cookies, local storage and similar technologies that are necessary for authentication, security, session management and the operation of the platform.
If we introduce non-essential advertising, analytics or tracking technologies that require additional notice or consent, we will provide appropriate controls where required.
15. Changes to This Policy
We may update this Privacy Policy as Maoni Africa develops, our technology changes, or legal requirements change.
The latest version will be published on this page with an updated effective date. Where a change is material, we may provide additional notice where appropriate.
